My question involves criminal law for the state of: NEW JERSEY
Today my husband was taken into custody because a complaint summons was filed against him for criminal mischief specificaly "keying the side of the victims car" at his place of employment causing damages in excess of $500. I believe my husband when he says he didnt do it. He told me that the Complaintant accused another co-worker yesterday of keying his car and today my husband is accused. He was put in a police car and taken to the State Police Barracks and held there for close to 4 hours. I didnt even know this happened until he came home and told me. He wasnt given a phonecall. He said he wasnt read a Mairanda Warning, was put in a 10x4 holding area, but was finger printed and frisked. I read the complaint summons and it gives no information on the time, the date or where it took place. He was never confronted about it by the complaintant and was totally in shock when the police came to his work and took him away.
My question is...Will this hold up in court?
