    Default Possible Deportation

    I have a pending theft case in Nevada, and it's my first offense since I got here., I went here October 2005. I supposed to plead guilty last month but my lawyer doesn't know that I'm not a US citizen, so he request for continuance of the case and he told me to consult with immigration lawyer because the court might send me to deportation instead o giving me probation because im not a US citizen. My lawyer also told me to just leave, go back to my country without having convicted and deported. What are the chances that the removal will be lift or not going to immigration court with this case? I commit the crime last year 2009, which its only my 4th year of being LPR. The case is still open. what's the best thing to do? My futre is here in US

    According to USCIS law that you're not to commit in 5 yrs of stay (anytime for all that matters) what would be the sentence or where you jailed/detained/picture taken, fingerprinted and such? And you plead guilty w/o a lawyer? Do consult with Immigration Atty. there is a new Immigration Law came out that if you we're being convicted that you are supposed to be ask in court if u are a citizen. So therefore, that you need to be appointed a lawyer bec. u r not a citizen for better results. I know someone here did same thing and same situation, but he's been here for over 30 yrs. but no. of yrs don't matter and he's not a citizen either, he is consulting an immigration atty to consult criminal attorney to withdraw his plead bec. court was supposed to ask if you are a citizen or not. His case I believe they didnt ask him...a new law of immigration law came out if LPR is being courted is to be asked if you are or not. Educate yourself in "USCIS law" online and share your knowledge and seek immigration atty just to consult your criminal atty....keep us posted here!
