    Default Criminal History Discrimination

    My question involves labor and employment law for the state of: About two months ago I was hired by a local retail chain. On my application I noted that I had been arrested and plead guily to a felony in the past. I was asked about it during my interview. I fully explained the situation that I had plead guilty to Possession of a Forged Instrument. Yesterday, after two months of employment a Regional Loss Prevention Manager came to the store to speak with me about my background. After the meeting, he informed me that I could no longer work for the company due to my criminal history.

    I don't understand how this huge chain retail operation was able to hire me then two months later change their mind and terminate my employment. The Loss Prevention Manager asked me to write a statement saying that I understood why I was being terminated and that I had been treated fairly. He also asked me to resign instead of being terminated. That seemed really wierd to me.

    I should also mentiono that I live and worked in the state of Maryland

    Even in the very few states in which felony convictions are protected (and Maryland is not one of them), they are NOT protected if the type of crime is related to the job the worker is doing.

    Possession of a forged instrument by someone working in retail should have eliminated you in the beginning. The fact that they hired you anyway, then decided the to fire you two months in, does not give you any cause for legal action. You had no reason to sign the statement, however.

    So, did you resign?
