    Question Guildelines on How a Parent or Guardian Can Spend a Juvenile's Social Security Funds

    State of Arizona

    Are there guidelines for how a juvenile's social security funds are to be spent by the parent's/guardians of the child? (survivor benefits, etc)

    For example: One parent dies, the child is still living with the other parent. Must the surviving parent follow any guidelines or restrictions in spending the survivor benefits the child recieves?

    Given the miniscule amount in question, no - if the child has a roof over their head, running water available, and eats every day, the legal presumption is that THIS is where the amounts is being applied. Courts simply aren't going to take the time to do nickle and dime analysis on an amount that in and of itself isn't enough to cover all the costs of supporting the child (just like child support payments aren't enough to cover 100% of housing, feeding, clothing, transporting, and providing medical care for a child).
