    Default Alimony After 13 Years

    My question involves divorce in the State of: New Jersey

    Fiance's ex is now no longer in oosession of the marital home.

    She is currently threatening to obtain alimony, which was never in the marital settlement agreement. Agreement stated all support would stop when the youngest reached age of emancipation or was no longer in school.

    Fiance paid child supportfor three more years than he had to, and was until last month forced to pay totla mortgage and other things in order to keep home from being forclosed.

    At least the home has been sold, finally.

    My question, of course, is can she obtain alimony at this late stage?

    They were married for 15 years. Divorced for 13.

    She has absolutely no chance whatsoever.

    Period. Even if.

    Unless their decree specifically allowed for her to seek spousal support in the future...which I heavily doubt!

    Thank You Dogmatique, for your response. It is a long long story, but there was NO ALIMONY in the MSA, or the final decree. Additionally, ex spent all of her equity in the marital home, as well as collected SSA monies as disabled on ex spouse's record for the kids and herself as if she were married to him. He then had to pay back SSA, and go to court to force home sale and her repayment of half the SSA, for which the judge made her sign an agreement that she had to pay half. Now she is stating she is after Alimony and not to have to pay the half of SSA.

    I really don't think a judge is ging to let her do that when the agreement was already finalized, do you?

    It is even worse than I have let on here, but I thank you profusely for th info.

    Dogmatique, I thought you ought to hear back from someone you assisted. We are OUT of this. She is now no longer persuing alimony. I thank you again for your assistance.
