    Default Adoption When the Minor's Father is Unknown

    My question involves name change laws in the State of: Pennsylvania.

    I do not know who my childs biological father is. My husband and I got married when my son was a little over a year old and he is currently 4. My husband thinks of my son as his own and wants to adopt him and have his last name changed to his. How do we go about this when I do not know who the biological father is?

    Why doesn't your hubby want to adopt your child if he thinks of this child "as his own"?

    She said he does want to adopt...

    Anyway.

    OP, you'll absolutely need an attorney because you're going to have to serve everyone you slept with during that very short window of time in which you conceived.

    If you genuinely don't know the identity of the child's biological father you will to do a John Doe service via publication.

    How do I go about posting a john doe?? I truely do not know the guy. I know this will sound bad but it was a one night stand with a random guy I met at a bar. Aside from him there were no other guys within the time period that I got pregnant that I slept with.

    This is honestly why you need an attorney; you'll need to do a John Doe service by publication and this really isn't something you want to do yourself because the last thing you want is for the guy to come back and have the adoption overturned.

    It's complicated because in order to terminate the biological father's rights, the father first needs to be given the chance to exercise those rights.

    Please, speak with a local adoption attorney asap
