    Default Defendant Failed to Turn Himself In, is Violating Restraining Orders

    to face domestic assault (includes broken bone) and restraining order violations. what happens next? does he go free until they one day catch up with him?

    Failure to appear generally results in the issuing of a warrant for arrest. Warrants stay active until the person is apprehended and brought before the issuing court. In actual practice, unless the warrant is for multiple homicides, don't expect that anyone will be ACTIVELY looking for a suspect - most are served "accidently" during other routine encounters like traffic stops, or, when someone who suspects or knows that a warrant is in effect notifies police that the person is in a specific place at a specific time, in which case attempts at apprehension increase dramatically.

    Glad to hear!

    Even though he has been arrested, until and unless you know for a fact that he's behind bars for an extended period, it is vital that you understand that this is the time when, statistically, you are actually in some of the GREATEST danger. Should he be released on bond, or should his sentencing be short and local (ie the county jail), the fact that there has already been violence between you AND he has shown disregard for the court's order to stay away indicates a very high risk level for there to be ADDITIONAL attempts at violence against you (or family, even your own children with him). For your own safety, I cannot encourage you enough to seek the assistance from your local domestic violence program in working on a personal safety plan, or, you can find an overview of things to keep in mind at:
