My question involves criminal law for the state of: WI
Hi. I live in IL and my boyfriend is in Wisconsin working a video job. We both work together at a marketing firm in Chicago. I am quite frustrated because he just called to tell me that was arrested briefly yesterday with these charges:
1. Marijuana possession (he said it was one level up from the very smallest amount you can be charged with. I am assuming an eighth of an oz?)
2. Possession of Drug Paraphernalia (grinder)
3. Illegal Turning (this is why he was pulled over. There was a lineup of cars and he pulled out of line to move ahead through the gate to make it to his filming location)
History: He is 27. He was caught with marijuana twice before when he was 18 and 19, but he never went to jail and it's never come up in the background checks he's done on himself or checks his employers have done. This was in Indiana.
Additional Problem: He has a court date set in two weeks to resolve a couple red light tickets. This is all in Illinois.
The Officer who arrested him: Said that one of the drug charges would probably be dropped and that he would probably just have to pay a fine. My boyfriend said the officer seemed really nice about everything. He was a different officer than the one who pulled my boyfriend over. She called for replacement because she had to go do something else. The officer who replaced her was very sympathetic because my boyfriend was very alert, compliant and helpful.
There was another guy in the car who was free to go without any charges, despite being equally responsible. My boyfriend does not want to incriminate him in any way though.
MY QUESTIONS:
1. This arrest situation spans a couple of states, is there transparency between states regarding arrest history?
2. If his past two arrests do not come up in background checks, then will it come up in his court date at the end of August for these three charges?
3. Will his ticket history and red light ticket court date in Illinois be a factor in his Wisconsin trial?
