    Default Indefinite Intermittent Leave Calculation of Days

    I have approved indefinite intermittent leave for a chronic condition. My employer uses the date of first incident. Approaching the end of 12 months I was asked for recertification and told each time I hit an anniversary that I used a day, it would be readded to my total available. Several weeks later was approached again and told my days would not add back. I would have to have my doctor completely release me before gaining any days back.

    Is this correct?

    Possible, Sounds like they're using the "rolling year" method of calculation. Ask HR.

    Yes, they are using a rolling year. Since this is a lifelong ongoing condition in which I will need periodic time from work, for the remainder of the time I work for this company, I will never replenish the fmla days?
