    Default Theft at Job

    My question involves criminal law for the state of: ohio

    I was accused of theft at my work in the amounth of $768.12.

    One day i found a $5 in my $20 slot in my till at work when i returned from break (another worker runs my till while i am gone) So i made the mistake of trying to cover the difference by voiding items. However one customer called and told the manager when at happened on the next day (i didn't know he called). My till ended up being over almost 18 dollars. Turns out i wouldn't have been short, however i voided the items to keep from being wrote up. Two days later i came in to work with the full intent to tell my store manager (who is a really nice guy) however he, and another manager pulled me into the office for a phone conferance with a guy from LP. I admitted to doing the voids at which point he asked where the money went and i told him i didn't understand, that it went to the store. He told me to tell the truth, that he *knew* i took it. I said that i didn't that my till was over for the day. He called me a lier again. I got the Store manager to pulll my report for that day. I was indeed over the amount i was accused of. Then the LP guy started on other voids i had done in the passed two months. the guy had an itemized list of about 10 items he said i voided and stole the money out of the till. He said it originally added up to thousands of dollars. (it didn't i'm good at math and looking at the list it was maybe $500) and that i should just admit to taking it. on the itemized bill it even shows on camra the most of the items are returned to the shelf after i voided them. the guy kept at me saying to took the money for the items i returned but i don't understand how there is money for the item if it was voided and returned to the shelf so I kept saying i didn't but i am 5months pregnant and have always been easy to bully. I eventually said *fine i'll say i took it* i signed a form saying i would pay $768.12 back over 6 months. The LP guy said that everything is settled now. How ever he talked to the Store manager about how much my last check would be ( yes they were going to fire me) after which the LP said they were keeping my last pay (which they did) and i did not agree to it. then after the LP got off the phone and said it was all over. The police came and got my statment which i thought was normal just to get my side of the case. They arrested me, booted me and released me until my hearing. that was on a friday. My hearing was first thing monday morning. Giving no time to find legal help. the judge had me wave my right to speedy trial so my next one is in about a month. Any advise would really help. (also i have received copies of nothing of the evidence like i asked.)

    You need an attorney...now! You admitted to multiple witnesses that you are guilty. Did you sign anything admitting guilt?
    The store LP will not, and in most cases cannot, release any evidence to the accused. They will release it only to a. Law enforcement/prosecution or b. your attorney if he/she subpoenas it.

    the only paper i signed was a paper saying i did the voids. I also didn't think it was legal for them to keep my last pay and STILL want all 768.12. so they would be getting extra money. i tried getting a public defender and am getting nowhere. the judge suggested i get i lawyer but didn't ask if i could afford one (which i can't bc i now have no job)

    It's like this...you need a lawyer.

    And the proper way to have handled the situation...I cashiered for a while. Shared register. I found a co-worker putting bills in the wrong bin ($5's in the $20 slot, etc). I went through all the bills and put them in the correct slot. Then I called over a manager and told her that "Lucy" was working the register for a while, and I had noticed money in the wrong slot. So if there was a shortage, she knew why. If there had been another register open at the time, I would have called management before sorting through the drawer.

    A deduction from pay cannot be withheld that would take you below minimum wage OR cut into your full overtime pay (federal law).

    Contact the state Dept. of Labor regarding your final paycheck.

    I agree that would have been the right thing to do. the problem is where i work no matter who was on the register, who ever has there name in it, is who gets in trouble. And anything over $5 u are wrote up for. I did call the manager over and tell them what had happened with the $5 in the $20s. I should have left it like that, it was stupid and i admitted it. but not $768.12 worth of stupid.
