    Default Disorderly Conduct at a Club in California

    My question involves criminal law for the state of: California

    Hello, first of all thanks for taking time to read this
    I was at a club event in Davis, CA (College Town) a few months back. Someone bumped into me inside of the club and i shrugged it off and didnt really mind. As we (my gf, my roomate) were leaving, I was attacked by about 10 people..they threw me to the ground and violentlyy kicked me in my face. My forehead was very swollen (I have pictures)....its human nature after u have gotten attacked to get up and yell as i did. I than began walking away to our car and the police officer came and arrested me? I am 6'6 im assuming he thouhgt since i was the biggest guy i started the fight. He than handcuffed me and took me to county jail while i and my gf are arguing with him that I was attacked. They put me in the drunk tank and they made me blow into a alcohol breathalizer and i blew out a 0.01 (which is quite low, its even lower than driving laws). After being detained for many hrs they released me in the morning and the police officer recommended that i be charged with fighting and disorderly conduct (2 differnt misdemanors). I have my arraignment on Wed and am quite scared because i have never been in legal trouble, ive never even got a speeding ticket. I have pictures of my head and i took pictures of my hands (showing no scratches or anything on knuckles indicating i didnt swing or hit anyone i was attacked). I also have about 5 or 6 witnesses willing to say that I was attacked. I am applying to Law School in the Fall and thus want to resolve this matter before sending out my applications. If i was fighting why was i the only one arrested? If they attempt to charge me with fighting dont they need the person i fought? I mean i didnt fight no one?? Can anyone please help I would really appreciate it. Thanks a lot.

    I suggest having a criminal defense lawyer assist you in preparing and presenting a defense to the prosecutor. It's going to be important to know what the officer wrote in his report about why he chose you to arrest, and what the rest of the witnesses have to say about what happened.
