    Default Rate for Paid Time Off After a Change of Duties

    My question involves labor and employment law for the state of: california

    he is my ? i work in california, i was a exempt pbm i earn my pto off as exempt employee.. then was ask to step down to a teller now i am a non exempt employee i work one day as a teller , then i went to the doctors he took me off of work for 3 weeks now they r playing me at the rate teller rate which much less , how been using my pto any help will be great .

    Sorry, I'm sure this isn't what you want to hear, but even in California, there is no law that states that PTO must be paid at the rate at which it was accrued, whether that rate be higher or lower.

    In fact, even the law about PTO/vacation payout at termination states that that payout is at the current rate of pay.
