    Default Underage Drinking on Private Property in Mn

    My question involves criminal law for the state of: Minnesota

    Coming home from a party I was stopped by a police officer as I was going in my door. I told the officer that I was going inside and I did not believe he had the right to retain me as I was on private property and he didn't have probable cause, as he certainly couldn't tell of any impairment from yards away. He threatened to taze me if I went further inside and then came and physically restrained me. They proceeded to breathalyze me, and I blew a .05. I am wondering if the officer had the right to stop me and threaten to taze me as I was halfway in my house, and if this would be grounds to get the Comsuming Alcohol Under 21 (Statute 340A-503-1-A-2) ticket dismissed?

    Of course he did.

    An illegal act is still an illegal act on private property.
