    Default Ending Child Support

    My question involves child support in the State of: FL / NY then KY

    I"ve paid support till the age of child became 18. He is in NY, orders were made in FL. Orders had written till 21 per NY terms. FL then ended the payments at 18 and I paid fees to close the case in May 2009. April 2010 I got notification of back support due from past May.

    In May 09 at age of 17 child left the house and lived on his own, didn't graduate from HS and lived with someone else. He did get his diploma last summer. Still living on his own. Dec. 09 Mother sold house and moved to KY. Child stayed in NY and does not want anything to do with her, he gets no support/$ from her and is on his own. He did get into community college from what I know. He won't talk/tell me anything about his life, where he lives, what he does etc. He does not live in KY with his mother. FL child support is trying to suspend my license for back support, I have filed to go to court next week to terminate support due to the child being on his own and the mother not taking any role in supporting him though now some how I get notice to pay HER support when she lives in KY and the kid is on his own in NY.

    FL says a child is legal age at 18 and support ends. But now they are saying I need to pay again he is 19. On his own, basically ran away from his mother and now doesn't want anything to do with me either.

    I did at age of 4 get court ordered visitation rights from NY that I am to be notified of his legal residence, have reasonable contact/visitation/phone calls etc. She has not complied with this at all over all the years. I can probably file for contempt of court for her not adhering to the terms. She has avoided any of my calls months ago and hangs up on me if I call after tracking down her legal address though the support office/courts would not give me her address. I know where she lives. Kid is NOT with her.

    What do I need to do next week when in court with the hearing officer to terminate my obligations of support since the kid is 19 on his own and the mother is NOT providing him with any support?

    I have my court ordered visitation papers.
    Copy/proof of her selling house in NY and moving to KY.
    Emails from kid saying she doesn't not give him any money for support or provisions.
    Emails from kid saying he doesn't want to go to KY or have anything to do with her.
    Proof that I paid support till he was 18 in 5/09 but he left the house prior to turning 18 and has been on his own since then. Living with friend only. He works but I don't know where or where he lives, have no phone number and only an email he at times will reply to me.

    I want my support payments to end since he is on his own and wants NO contact from me or his mother.

    I forgot to add that the CP/Mother in KY will not have contact with me, return any phone calls etc and my kid in NY will not either contact me or provide a place of residence/phone number or any other way to contact him except an occasional reply email from his yahoo account.

    Do I have a good argument for termination of support as over all the years it's been a one way street with them taking only. Even that fact that when my other son was born with birth defects and was getting aid/disability and my income tax refund (due to HIS disability) was taken to pay her back support. Talk about the system being screwed up...taking from a disabled kid/his benefits to pay HER back support.

    My only recourse is to file contempt of court papers for visitation but if they don't want contact with me why should I have to pay her? I just want this to all end and not deal with them now either.

    I know what it's for and she is NOT paying anything for him after he left the house at age 17. She got 18 years of $$$$ and now it's time to stop sucking off me and move on. If this were just a simple FL case it would be over, but it involves NY and now she doesn't even live there or give him any $ since he left the house in 4/09. It's called child support and not ex-girlfriend support. If she is not supporting him why should I have to pay her a dime? Even the kid hates her and doesn't want a thing to do with her.

    Update: All pending back support/arrears ordered to $0.00. All future support to the age of 21 dismissed. DOR/child support attorney in court said quote "I'm the one who committed the forgery"

    Cost me $1500.00 in attorney fees to save approximately $4000.00

    Now to file in small claims to get back my costs and excess paid in support that I should not have had to pay, bank fees, license reinstatement fees, attorney fees, and I even want them to fix the bad credit report too....

    Justice isn't automatic...you have to fight for it!
