My question involves criminal law for the state of: Michigan
Over the weekend i was leaving a party and got into my friends car as he was giving me a ride home. i had been drinking and am 19 years old. as we were about to leave a cop pulled up behind us and accused us of trying to steal the car which was owned by my friend. he asked us to get out and then proceeded to question us. he called for backup and said we smelled of intox. so he cuffed me and put me into the back of the car and breathalyzed me. i blew a .15 and i guess my friend blew a .06. i told the cop i wasnt drinking before the pbt and my friend told the cop he was beforehand. so in the end i was given a ticket and the friend wasnt. so i guess its better to tell the truth...but on to my question. i have never been in any trouble in my whole life. nothing. im a 3.5 student in college(which im sure doesnt matter) but this is my first MIP offense. ive been bouncing off the walls about this and im not sure how big of a deal it is. should i just pay the fine and forget about it or is it worth going to court and trying for a diversion program. all in all its gonna suck to have it on my record and im just not sure what to do. any advice or prior knowledge off any sort would be much appreciated.
