    Default Minor in Possession in California

    My question involves criminal law for the state of: California

    Back towards the end of May a friend and I went out to the Hangtown National Motocross race towards the outskirts of Sacramento. Right after we parked in the big parking area we were getting ready to head into the races and my friend set his beer down next to my tire. A parks ranger drives up slowly and my friend ducks down and takes off. As the ranger is stepping out to question me I get a text from my friend saying something like "just take all the blame, it was your truck so you'd be getting in trouble anyways if i stayed.. this way i dont get in trouble". I didn't want to rat out my friend so when the ranger assumed the beer was mine I just went with it.

    I was being very nice and assuming nothing would really come out of it since I had not drank any alcohol and it was not in my truck. So she writes me up a ticket for B&P 25662(a)

    I just received a court date today in the mail and it happens to be on my first day of college. Now my questions.. Is it possible to change my court date to an earlier date? I read online that I am likely to lose my license. Is there anyway I can get a restricted since I don't live with my parents anymore and I need to get to work, school and back home? Are they going to pull my motorcycle permit also? And is there anyway to lessen the charges if I inform the judge that the alcohol wasn't mine and was a friend who ran off when the ranger pulled up?

    The judge has heard the "it wasn't mine" story before. Now, maybe if your friend came in and 'fessed up to the alcohol being his, the judge might cut you a break.

    If convicted, the court "shall" suspend your license. But the court may also allow you to apply for a restricted license.

    You might consider consulting an attorney if you desperately need a license or will not be able to appear on the court date. If you FTA and do not get a continuance or take care of it before hand, a warrant will almost certainly issue for your arrest.

    I would consider a new friend, as well.

    He threw you under the bus pretty fast... and then texted you why it was a good idea.
