    Default Broken Light Fixture

    Hello all,

    A friend of mine is a nurse in an assisted living home. She was at work when a light fixture fell from the ceiling and hit her shoulder. The ceiling support or drywall began to collapse over time due to rain and leakage, which eventually lead it to fall. My friend has accepted physical therapy from a doctor retained by the nursing home under workmen's compensation, and the nursing home I believe is paying the medical bills. Would she be able to bring a claim for negligence against the nursing home? She lives in Indiana, and wants to know if she should find legal representation. Thank you in advance.

    If the nursing home is her employer, her remedy against them is through worker's compensation.

    It explains the Indiana system quite well. and yes, it does support Mr K's statement of WC being the exclusive remedy. It includes a lot of other information specific to Indiana that might be of use or need of your friend.
