My question involves an eviction in the state of: Indiana
I need to know what is the legal time limit in the state of Indiana for a landlord to file an eviction? i have a friend who lives in a apartment complex. she is unenployed and was receiving her unemployment benifits un time they ran out. She has been seeking work, and she has 3 young children, on of wich has a disability, and receives SSI payments for her condition. Because the job my friend was working for closed there doors, (she had worked there for 8 years) and she was receiving unemployment, they cut her child"s SSI check to 1/4 of the amount she was receiving. when her unemployment ran out, the SSA took over 30 days to to raise the check back to the regular amount. This caused her to not be able to pay her June rent. Rent is considered late after the 5th day of the month, and the charge a late fee. Then after the 10th day they charge additional late fees. On the 20th of the month they filed eviction proceedings on her for the month of June. So my first question is dose the landlord have the rite to file for eviction before the rent is 30 days late? also, she has went and applied for rent assistance at diffrent agencys, and one is willing to help her but it may take up to 30 day to do so. She did receive SSI for this month and paid a month rent with it.
