I'm a teacher at a Catholic high school and was accused by a student of something I did not do. Several students essentially blackmailed me into offering a resignation which I did verbally to the principal out of fear (they threatened to tell all sorts of lies and I essentially caved). With everything going on in the Catholic church people accused of such things are always considered guilty.

The principal at the time said that I shouldn't resign as it would only make me look guilty of something. The school lawyer on the other hand told her to just accept the resignation. I tried to take my verbal offer back at that point but the principal declined to allow me to do that.

I was going to wait until the child service investigation completed until i asked for my job back but the girls involved told some whopper of some lies and my lawyer told me not to defend myself till the substantiation hearing.

The question:

My contract specifically stated that any resignation by a teacher must be in writing which I never gave and my verbal offer was insincere, under extreme duress and coerced. Can I make a valid claim that my verbal offer of resignation was not valid and there fore void or something to that effect?

At present I have to go to a substantiation hearing to clear my name hopefully. I'm not sure if i will be able to even do that and this contract dispute will be for nothing. But do I have any case for getting my job back and can i file a lawsuit if they don't offer me my teaching positon back if I am cleared?
