My question involves criminal law for the state of: MN

Hoping someone on this forum can help me understand possible reprecussions of my fiance's kind, but woefully ignorant, actions.

Last Saturday he worked with a lady who had extreme back pain. To be nice, he gave her some of his little brother's hydrocodone, which was kept in its original bottle with the brother's prescription label. Said coworker, a night later, got pulled over for a DUI (blew a 2.0) and had the pills on her. Because prescription of a controlled substance was not hers, she's getting charged with felony drug (5th degree possess controlled substance) and a DUI.

They called my fiance, who said he didn't know how she got the hydrocodone; she had said that she found the bottle on the floor of the restaurant they both work at. Problem is, the night she said she found them (Thursday) doesn't match up with the rest of the story that's been woven to protect the innocent, albeit stupid. My fiance's mom and brother were dragged in and his mom (truthfully) said they were at the restaurant Saturday night and that they could have fallen from her purse during that time. The lady, however, wasn't working that night.

Out of all of this convoluted mess, I'm wondering what my fiance, if found to be the distributor of a controlled substance, could stand to face as a first time offender. So far the only relevant statute I've found is Minn. Stat. § 152.025, but I'm not sure that's what he'd be charged with, if convicted. I am seeing maximums of 5 years and 10K fines.

Would it be better to call the PD back, just say, "Hey, I was a moron and freaked out when being interviewed by the police, had no idea that it was a controlled substance, gave it to her to be nice..." or to ride it out and see what happens? The main issue is the gap in when she "found" them; my fiance's mom is also unwilling to say she had been there earlier in the week to try and make the story more legit.
