    Default Monetary Punitive Damages for Rape

    How much money is usually awarded to a rape victim?

    There was a small company that raped my girlfriend. They beat her unconscious then raped her. They may have used drugs to keep her unconscious. We think four men raped her total. We have to prove it. But with O.J. Simpson, he was not found guilty criminally -- but civilly liable. Could this have a substantial award?

    A substantial award is REALISTICALLY only substantial if the defendant HAS the money to PAY any amount awarded. Unless the accused is a very well off financially, typically by the time they're done paying for their defense in criminal court, there's not much left to pay a victim WITH, should the victim prevail in a civil case. And, if convicted in criminal court, the ability of the defendant to EARN money is minute while incarcerated, and future earning ability is usually severely impaired.
