my unemployment insurance appeals board hearing the ALJ used my non-disclosure of my being on probation against me - claiming i wasn't acting in "good faith and fair dealing with my employer" testimony during the hearing by the employer was that "they never inquired on my application or directly about any criminal records" as well as "it wouldn't have affected thier decision to hire me" Does the ALJ's claim have any basis? it is my understanding that if the employer doesnt ask then yoiu are not REQUIRED to tell? is this correct?
