    Default Changing My Son's Last Name

    I was wondering what the rules and laws were about adding my last name to my sons name I wasn't married and gave birth to a little boy in the state of Texas and we gave him his father's last name and now he doesn't want anything to do with his son and I want to either change it or add my last name to his what do I need to do

    He says he will but I don't really know he is in jail right now and will be for 3 1/2 years and he wrote me a letter telling me that he didn't want to have anything to do with his son and that he will give up all rights and still pay child support I don't really want to take his name off I just want to add mine untill I get married and then change it all to my husbands

    You can file a name change petition in the county court, identifying on the petition the court which issued any custody or support order. The father is entitled to notice of the petition. You can download a form with instructions (in PDF format) here.

    Ok we have not gone to court over any of this do I need to do so before, and if I change his last name does the father still have to pay child support? And if I were to just add my name with a hyphen would I have to go through all the same stuff or does adding my last name really make a difference and if he doesn't agree to signing over his last name is there anyway it can be ordered by the court since he had told me in written that he doesn't want to have anything to do with his son

    Simply changing the child's name doesn't change the support obligation.

    If you want to use a hyphenated name, and don't care that for some legal documents and purposes (e.g., school enrollment) you might still have to use just the father's last name, you can simply start using it.
