    Default Grandchild Not Named in Will

    My question involves estate proceedings in the state of: NC

    My mother has passed away and her will leaves her estate to my brother and me, to the exclusion of my daughter. This exclusion was not intentional, just one of those, "I'll get around to it some day."

    My brother is in agreement that my daughter should share in the inheritance.

    The question is: how do we get @ $50,000.00 to my daughter. Preferably without her knowing that she was not in the will.

    You can each make a gift to her of $12,500 before the end of December and again in January, thereby keeping the gift amounts within your exemptions and below the threshold where you would have to file a gift tax return, thereby transferring $50K to her.

    What MrKIA suggests of course will not hide from your daughter the fact that she's getting it as a gift, not as an inheritance. But I think it's best not to try to hide it -- just explain it to her as you did here. The fact that both of you are making large gifts to her will make it clear that you think that was your mother's intent.
