    Default MIP in Missouri

    My question involves criminal law for the state of: Missouri

    Alright, me and a buddy got MIPs the other night, were 19. It was about three in the morning and we were sitting on a bench at a public park. The rangers come up asking if we had been drinking. we say no. he says he smells it and asks us to take a breathalyzer. we refuse and end up getting MIPs because we were "visibly intoxicated." We had no alcohol on us and didnt blow. What are some possible outcomes and penalties of such a ticket? How do I plea? etc.. I am going to contact a lawyer but decided to ask here to satisfy my curiosity.

    What statute were you cited for? Let's start with a statute or code and go from there...

    If it's 311.325, then yeah, you're looking at a misdemeanor. 311.325 allows for someone "who is visibly in an intoxicated condition" to be "guilty of a misdemeanor." Talk to an attorney.
