    Default Getting Money Back From an Ex-Roommate

    My question involves a roommate in the State of: Florida

    I moved in with a friend last August. We were both on the lease and were paying everything 50/50. In January he moved his boyfriend in and in February mine moved in as well. Neither was on the lease. Before anybody moved in we agreed that no tobacco or illegal drugs would be used on the premises. By March my roommate's boyfriend had begun smoking pot on the property. In May my boyfriend and I moved out, but because my roommate didn't make enough money to only have the lease in his name and his boyfriend didn't work, the apartment complex would not let me off of the lease. On June 1st I paid my roommate 1/3 of rent as agreed. I found out two days ago that he never paid the rent and was evicted. The apartment complex realizes that I did everything I could and so nothing has gone to collections on me, and I will not have an eviction. My question is in regard to the 1/3 of rent that I gave him that he never used to pay the rent. I asked him about it via text and he said I would get it whenever I get it. He has bills to pay that come first. I tried calling the police department and they said it's a civil manner and basically to handle it myself. Any idea what my best plan of action would be?     not real sure why it was only 1/2 of the rent as you were 1/2 of the tenants but anyway, small claims court is about your only recourse if he will not pay you willingly. Getting a judgment still doesn't mean he will pay you but it can give you some options.

    Oh, and the LL can come after you if you were not removed from the lease you might want to check the eviction as they would have to evict both parties, not just the one.

    I was only paying 1/3 for that particular month because he moved someone else into my room and it was the amount we had agreed on. I realize that the landlord COULD come after me if he chose to, however I spoke with him as well as collections and there is nothing on me at all. If he doesn't pay me (the ex roommate) and I have a judgement, can he go to jail, ordo I just have to keep asking? If that's the case I guess it would be best to just walk away, lesson learned.
