My question involves a speeding ticket from the State of: CA
I just received a speeding ticket this morning going 45 in a 35 mph zone. The conviction was noted as CVC 22350 unsafe speed, 45 on 35 zone, 500-some feet using a laser gun, with a promise to appear date for October.
I wasn’t the only one caught as few minutes later another police bike pulled over another car for seemingly the exact same reason. As such I have my suspicions that this was a speed trap.
Using the search function on this board, I went to helpigotaticket.com to read up on what I can do to fight the ticket. But still I’m confused where to start.
A. Can I already start requesting an informal discovery right now or is it too early as I just got my citation today and the court appearance date is in October? Or does this have to happen after going to court or submitting TBD and pleading not guilty?
B. Rather than going to the pain of going to court, I want to do a TBD as it gives me the chance to Trial de Novo if it fails there. Is it too early to submit this request, or shall I wait out until one month prior to prolong the memory of the police officer who pulled me over? Who knows, by the way of how broke my state is, the officer may not have a job at his department by them due to budget cuts.
C. Whom exactly should I make the informal discovery requests to? The alleged offense occurred at Los Angeles County, City of (not LA), issued by (not LA) Police Department, but the courthouse that I’m supposed to appear is at in the City of (another not LA). The LA County DA? The City Attorney of City of (not LA)? The police department that issued me the ticket? Or the courthouse?? So confusing!!
D. Already went to traffic school a year ago so wondering if they’d deny me of going back to traffic school again. Any tips on this end? What legal mumbo-jumbo to say when?
