    Default Traffic School Eligibility

    My question involves traffic court in the State of: California

    A little history first. I was pulled over on 5 highway and cited for going 99 over 70.

    Under the CA rules, I am not eligible for traffic school since it's 25mph over limit. And so I figured there is no harm in filing for TBD(which disqualifies me from traffic school?). People are actually telling me to employ services from sites like 2fixyourtrafficticket to do it for me, but I'm iffy about paying another 200 bucks on top of the bail money.

    The point of my post is, while my courtesy letter failed to state whether I am eligible or not(it contained precious little info in fact), when i logged into Fresno online pay site to pay for my bail, I discovered that it listed my eligibility as yes.



    This may be a stupid question, but should this be trusted? If I am eligible, I rather just pay my bail and get this ordeal over with instead of waiting on TBD. They can't charge me the extra 64 dollars for traffic school(with no refund) and declare later on that I'm actually not eligible right?

    Being cited for 25+ over the limit does not necessarily disqualify you from being able to use traffic school for a dismissal. Pursuant to California Rule of Court #4.104, the court clerk does not have the authority to grant your request if you were cited for 25+mph over, which means that you must ask the judge if he/she will allow it.

    Sounds like this particular court might be doing things different than others. Then again, if your courtesy notice did not offer you that option, I would assume that you are not eligible and you would have to appear in court for your arraignment to ask the judge if he/she will allow it!

    With that being said, why don't you call the court, speak to a clerk and get a definitive answer?
