My question involves landlord-tenant law in the State of: California
My husband and I applied for tenancy at a ranch home in a rural part of California. I was offered a job working at a horse training facility, and the owner offered us the rental house that is situated on the property. The house is completed fenced off and has its own driveway separate from the business.
While the house is being updated (new carpet, paint, appliances, etc) the landlord provided us a tentative lease agreement she uses for her rental homes. In the lease, it states:
"The Tenant agrees to allow the Landlord and her guests/employees to use the bathroom as needed."
This clause has made my husband and I uncomfortable. I would think that this clause breaches the tenant's privacy and quiet enjoyment of the rental unit. Also, this scenario would put us at risk. Not only could the landlord's guests or employees potentially steal or damage our items, but they could also damage the rental unit or leave a door open and let our cats out (cats have been approved by landlord). There is a busy road adjacent to the property with a 55 MPH speed limit.
The landlord justifies this part of the lease by stating that the barn on the commercial property is still under construction and that the plumbing/bathroom there is not yet installed. However, there is no indication of when it might be installed, as the barn is already in use and there doesn't seem to be a demand for the bathroom as the house bathroom is being used while it is being worked on.
How should I open discussion regarding this unique issue? The lease is thorough and reasonable with the exception of the clause. I have had no problems with the owner/landlord so far as an employee. The proximity, price, and location of this home is ideal and we very much want to move in, we just don't know how to approach this issue. Obviously we want to remedy it before we sign any lease agreeents. The landlord stated she already has approved our tenancy and is waiting to do a walk through until the house is finished.
