    Default Passport for Minor

    My question involves a child custody case from the State of: California

    My ex put father unknown on the birth certificate for our child. I know she will apply for a passport to take our baby out of the country. My ex is not a permanent resident and her visa is up. She's technically illegal here.

    One of the criteria for getting the passport is "Minor's certified U.S. or foreign birth certificate listing only the applying parent" and I'm wondering if putting father unknown qualifies. Does it fit this definition?

    If so, that means I have to establish paternity as soon as possible but if she's planning to run away with the child, I'm worried that the whole legal system will take too long to allow me to stop her from getting the passport.

    If you choose not to establish paternity and, as a result, your ex moves to another country with the child, the person you need to be angry with is the guy in the mirror. You need to be a legal parent to use the State Department's passport alert system (CPIAP).

    Thanks, I'm not choosing not to establish paternity. My problem is that she had the child without me present, got the birth certificate and left me off the certificate. So now I have to establish paternity but in the meantime, that leaves her probably enough time to get a passport and take off.

    So I'm wondering if having no father for the child on the birth certficate will create a problem for her in getting a passport for the baby.

    Thanks for the link to CPIAP BTW. Only problem is, I'm not on the certificate so I can't apply on that.

    When did you learn about the pregnancy? How long ago was the child born. When did you file your paternity lawsuit?

    If anything, it makes her job a lot easier.

    She is sole legal parent at the moment; that's all she needs in order to obtain a passport for the child.

    The child is 2 months old. She ran off after I found out 5 months into her pregnancy and had the child without letting me know. A few weeks ago she let me see the baby and I inquired about the birth certificate.

    I have not yet filed a paternity suit, I'm getting ready to do so. But if the information provided on this forum is correct, she can skip out of the country with the baby.

    I had read elsewhere that having no father listed on the birth certificate of an infant makes it a bit more difficult to get a passport. It would be great and makes sense to protect a father like me in this case. I can't imagine I'm the first person in this situation where a vindictive ex wants to take a baby back to her home country. I was almost helpless in knowing when and where the baby would be born. So she took advantage of the situation and left my name off on purpose. It was only through friends that I found out and was able to see my child.
