    Default Petty Theft Over $100

    hello,
    actually am living outside the US and amn't a citizen , this was in Orlando Exactly 2007 , i was convicted in a 1st degree MM over 100$ at Macys and i went to the orange county where they took my fingerprints and photos BUT IT WAS MY FIRST OFFENSE worldwide ,but this happened in my last day after booking my fleight back to my country and my visa was already finished (J1 visa) so i missed my court and so there was a capias for my arrest
    and know am working to solve this black case by leading attorney and after he checked he told my it'll be just for paying fine and court costs.

    Now the problem is i got a very good offer from an US company in my country which will offer me training in the US after 6 months , will it be easy to re-enter after resolving this case??
    If not howlong i have to wait to re-enter??

    A petit theft conviction, for items that are valued at more than $100 but less than $300, is a first degree misdemeanor carrying a penalty of a fine of up to $1000 and up to one year in the county jail. As such it may interfere with your obtaining a visa, but should fall under the petty offense exception such that it does not preclude your obtaining a visa.

    If you were convicted, you were presumably sentenced. What was the sentence? If it was only fines and court costs, then you might be able to pay them and return, but you'll still have a lot of problems getting a visa. If you were sentenced to probation, you'd have violated it and would be arrested; getting turned back at the border is the least of your worries.

    That you say you missed your court date suggests you weren't convicted, though; "convicted" means you were found guilty of the crime. If you merely left the country before your court date, then there is a warrant for your arrest, and you can be arrested when you return to the US. You'll have to stand trial for the original theft and other charges due to your leaving the country, and may be convicted of all of them, which isn't likely to impress your employer.
