I was accused of third degree sex offense in Maryland in November 2009, picked up on a fugitive from justice warrant in my state February of 2010, and released the next day because Maryland would not extradite.
My lawyer says just don't go to Maryland. He tried to get the prosecutor to drop the case, since the "victim" declares sex happened I say it didn't, and she lied about her age (she is 15 but claimed to be 19) and even admitted to police she had lied about her age, which is no help due to strict liability if they can convince a jury sex took place, but certainly proves she is a liar and makes her allegation that sex took place less believable, but at this point the prosecutor refused to drop it. Of course they have probable cause (her statement that sex took place, we both admit to meeting) but no evidence sex actually took place (since sex actually didn't take place; in addition to lying about her age she also lied about her physical appearance) and my lawyer says there is no way to tell what a jury might decide so I should avoid going to court if at all possible. Howevre having this hanging over me is extremely stressful and alienating my family.
Is it reasonable to expect the prosecution to drop the case at some point?
What factors would make them agree to drop the case, or is this just a pipe dream? My lawyer says passage of time is in my favor, but how much time? Should I try again in a year?
My lawyer also said contacting the prosecutor on my own would be a mistake, so I am just wondering, is this true and I should keep paying my lawyer a fee each year to ask the prosecutor to drop the case, or is this a waste of money?
My lawyer said contacting the girl or her family to try and get them to retract anything is a mistake, and might make the prosecution change the warrant from non-extraditable to extraditable, plus girl is under control of her parents.
What factors, other than contacting the "victim" or her family, would make them want to change the warrant to extraditable? What if I wait until she is over 18, then try to get her to retract her accusation?
I simply have no basis to evaluate what my lawyer is saying... he is not easy to get a hold of either, but for all I know I would receive the same treatment from any lawyer and it is just an unavoidable part of dealing with criminal justice system, and I really have no indication that he is doing anything untoward either, so there may be no reason to move on to a different lawyer, but if the things he say do not sound reasonable to other people, I would be more inclined to try a different lawyer.
