    Default Can My Disability Income Be Garnished

    My question involves collection proceedings in the State of: PA

    Hi, I get disability income through my insurance company. Due to the nature of my illness I will never be able to work again. I live in PA but my insurance company in based in Maine.

    My spouse is unemployed as she is my full time caregiver. We don't own a house (we rent). Our car, a 1999 model is paid for.

    The income I now receive through the insurance co. is only a small percentage of what I used to make. We are still paying our credit cards but can only pay barely over the minimum and with 5 different credit cards that will take years. I'm not sure if we qualify to file for bankruptcy (am currently waiting on a reply from a lawyer)and would like to settle with our creditors but we have no savings and no 401K.

    My question is can my creditors garnish my disability income directly from my insurance company?

    From what I have found, disability benefits are protected. Please note, however, that if they're being deposited into a bank account it's conceivable that the creditor might try to garnish the money that's in the account. You can generally get it back if you prove it was from an exempt source.
