    Default Suing Over Minor Injuries

    You are to be commended CM1978! Many people today get lawyers & try to make $$ from exaggerated injuries. Some even wanting to sue above & beyond 100k policy limit that someone is insured up to. Many times I see that they discover a little defect they hadn't had before & expect the party at fault to pay over that 100k- even though they have medical insurance to get the surgery. Those are the ones who "hurt" others personally bc of their greed & dishonesty. And make all of our insurance premiums go up.
    And they don't want to work for their "riches" either. The love of $ IS the root of all evil.
    Here you even have a DUI & you are generous enough not to ruin the poor idiot who owns the vehicle's life. I think the public cares that the drunk driver is off the road & deals with her DUI charges. That's a must.

    You didn't say exactly what injuries you incurred (as some minor injuries do not come with much of a price tag anyway) But if you feel secure about payment & satisfied on what their insurance will compensate you with & for-
    then - you are no fool - & you are a good person. And you'll probably be compensated sooner than if you got a lawyer. Get well soon!

    Thanks for the encouraging words Rymfire. My injuries were minor; shoulder and back pain. My doctor says I most likely had these pains before (which I did), but were aggravated by the accident. When I mentioned getting an MRI and submitting it to the ins company, he suggested it was not a good idea because THEIR doctors could claim that the injuries were there before the accident especially with the work I do. (lots of lifting, physical work on concrete floors) and they may argue over the medical claims.

    I'm not looking to retire off this ordeal. I mainly just want to get my life back to normal, get a new vehicle and the 2k on top of that is money in the bank.

    Oh and the girl that hit me? I had my brother-in-law who is an officer where I live look her up. She's still in jail, unable to post bail. Her license is suspended for a year and her court date is coming up soon. So she's reaping what she's sown.

    Never mind motivation. You really don't know what effects you might have.

    STOP. Never try to negotiate with an opposing insurance company without an attorney. I don't care how smart you think you are or how minor the damages, don't do it. Even if you have to give up a chunk to the attorney, it will generally be worth it.

    Those numbers are nuisance chump change. He probably has some high risk insurer who is going to give you the minimum. I have had insurance companies give me ten grand just to go away.

    Here in Florida you could sue the drunk driver for PUNITIVE DAMAGES. Have an attorney explain that to you if your state is the same, which is highly likely.

    I am not saying you should try to turn this into a big pay day (though a lawyer would), but you never can trust the opposing insurer.

    And I differ with you. The ambulance chasing lawyers are capitalists who think bc they went to law school ,the insurance companies should support them. And they take advantage of people- not help.
    I am soooo happy the 2 lawyers- that when they saw the policy limits of 100k for my husband's accident-& they wanted all of that for faked & exaggerated clients with 0-to minor injury- well they were offered less than 10k each. One of the "victims" has 8k in medical bills outstanding (after running up an 18k tab medically- looking for more 'pre-existing' stuff she could claim) Well, the lawyer will get 30% & accordingly, but she will have to pay all the rest to the doctor bills!

    Those are the moments (reading the response to the demand letter) that make life worth living!
    So, the lawyer would get 3k- but the "victim" gets nothing bc she owes 8k for medicals.

    If she had just claimed with the insurance company & stopped with the 10k no fault PIP allowed for medicals- she would have had a profit. But now, since she didn't even take the treatment from the 1st doctors advice (bad move) & went to a lawyer bc of greed, she owes even more @ this point.

    So the OP would probably be getting more by just what the insurance company is offering.

    I know our insurance co. is looking out for their own finances- but, at the same time I feel they are looking out for us- bc the less they pay the better for our premiums.

    People need to learn to walk away & just take care of their cars being fixed- instead of faking & hassling others bc they see the ambulance chasers on TV.

    Spoken like somebody who, frankly, doesn't have a clue what she's talking about. You had a bad experience, so every lawyer in the world is evil? Get some perspective, girl.

    This is a legal forum. You hate lawyers? You hate the law? Whatever. Your political banter doesn't belong in threads where people are trying to get legal information. Save it for the social forums.

    Its probably some one who works for insurance. Notice they changed the banter from increasing premiums to lawyers being bad and greedy to his/her own bad experience.
