Is a court order affected by a garnishment agreement that follows at a later date? The court order stipulates every other weekend for the father of the child. However, when the mother eventually had child support garnished from him, they had verbally agreed (which does *not* alter the original court order, I was told by a lawyer) to the father having the child every Friday night until Saturday afternoon due to prior work restrictions. Because his schedule has recently changed, the father has weekends available again, the mother wants to return to the court order of every other weekend. The father is stating that he is paying to see his child every Friday and refuses to change.
From my understanding, if the father wants to alter the court order or the garnishment agreement, he has to initiate the change. Because the court order stipulates every other weekend, the mother has the right to exercise that, the latter garnishment amendment notwithstanding, correct?
