    Unhappy Caught for Theft at Wal-Mart

    My question involves criminal law for the state of: Arizona
    I was stopped at the door by the LP guy He took me to the security room where he asked me to take out what i has stolen. At first I said i didn't have it and told him the box was empty when i looked in it. (It was a Usb wireless device) He didn't buy it, so he said if i cooperate that they wouldn't call the police. I gave up the goods and he took my info down since i didn't have my id with me. They gave me a paper saying i would have to pay $250 restitution (btw that i signed). I will be receiving that in the mail 4-6 weeks he said. The police were called anyways because the item was $37.97 so per policy thats what they did. When the police arrived he read me my rights said i was under arrest but did not actually arrest me then they took a picture of me along with the item and I was given a citation (ticket) with a court date for next month and released.(The charge is Theft/shoplifting on the actual ticket) I tried to ask the officer if they could just drop it he said no but judge was pretty lenient to tell the judge that i was stupid for doing what i did and Ive learned my lesson.. I don't need this on my record its hard enough to find a job much less with this to hinder me more. I have priors on my record but not for theft/shoplifting. They are disorderly conduct and one agg assault. but they are misdemeanors and have been set aside. its been 6 years since Ive been in trouble. I'm wondering if there is anything i can do to help me out so this does not get on my record. I have set up some appointments with attorneys and Im probably going to plea not-guilty at the arraignment. any advice will help. Thanks

    Hey, you have plenty of experience! Talk to your attorney!

    As for not getting on your record— it's a bit late for that. It's already on your record. Even if you get the whole thing dismissed, it'll be on your record, unless you can get it expunged; I don't think that's possible in Arizona, especially if you're convicted.
