    Default Delivery of Marijuana

    My question involves criminal law for the state of: Washington State.

    My friend's house was raided 11:30 in the morning. I had my pot there for safe keeping. I had left it there at about midnight the night before and then checked myself into a local hotel. (had a very long day and was VERY tired and didn't feel safe bringing pot into a hotel or leaving it in my car). I called my friend at 10 when i woke up and he said he was busy for a little bit. at noon i called and told him i needed to leave town to get home my friend was going to miss a birthday party. He said i don't know where my friends are but you could just leave your stuff here until next week. I said what??? and was like why would i leave my stuff with you for a week? i need it! i hung up the phone and drove straight to his house being very weirded out at that point. when i arrived i got bum rushed by police while i was in my car and they arrested me and booked me for delivery the night prior. they questioned me for awhile before they jailed me but they were not direct with their questions and i did not admit to anything but having a tiny bit of pot in my car. their police report when i made it to court stated that i admitted the 3lbs of pot they found was mine and that i knew my friend was selling it and the price he was attempting to sell it for.

    NOT once during the questioning did they say anything about how much weed was there only asked me how much it was worth and i said i didn't know anything. I am a current medical card holder and a caregiver which allows me to have up to 3lbs of marijuana. now what sucks is i had JUST moved into a new house 250 miles away i had 19,000 in my car (my life savings and 9000 of it my mom had just given me weeks before i have proof) and they took everything. I am currently homeless, broke, no medicine, and fighting the legal system based off a statement and the police saying i admitted to everything.

    sorry for the long story... but HOW and what can i even do here? my free lawyer says i should probably just take a plea bargain. Does the statement my so called friend made against me + the police saying i admitted to everything (when i didn't) pretty much screw me here? My friend was a medical patient as well and that is the only reason i asked to store my stuff there for the night.

    Did you have a medical card for the jurisdiction that you moved into?

    yes, anywhere in washington i am allowed my medical marijuana other then schools and public places. i had driven around 800 miles the day before taking my dad to the doctors and trying to return home before i found myself to tired to make it any further. otherwise i would of been at home safe and not arrested for something i didn't even intend to do.

    Does your friend have the same right to three pounds of grass?

    You see, it WASN'T in your possession. You dropped it off at a friend's house. yeah yeah... I heard... you didn't think it would be safe in your room or car... but the pot on you would be.

    I, and the court, will believe that to be a very poor excuse for drug dealing.

    At the very least, your MM card is toast.

    No he was only allowed to have 1.5lbs... and they are not taking my medical card away from me according to the judge and my lawyer. and i WAS NOT drug dealing. I was taking my pot home. My "friend" said i was selling it...

    No, YOU put you in this situation by storing your pot illegally.

    And I guarantee that any drug plea or conviction means your MM card is toast.

    So your telling me if i left a bottle of oxycotton's at a friends and then came over to pick them up the next morning i should be charged with delivery? 1 to 5 years in prison for a MINOR storage overnight issue seems absolutely absurd.
    This is going to ruin my life, lose my new car my mother just bought for me, lose my life savings, and make it even harder to get a job! its already hard enough finding a pot friendly job. I had been my fathers caretaker for 4 1/2 years and all my expenses were paid. it just doesn't seem right to me im labeled a felon criminal and losing everything i have because someone else did something wrong and is looking for a way to reduce his sentance.

    Are you saying that the pot was medically labeled? Or was it just a 3 lb bag of pot?

    sounds like you need to come to liberal-fornia!! i've had glass pipes and various amounts of hash or kief with me when my or anothers vehicle was searched and they never really bat an eye about it... especially when they got you for driving on a suspended dl, of which i was NOT convicted nor a driving on suspended a month prior, cha!!!! got the car outta impound 24 hours and $500 later and all was still waiting. oh, and i never hear about those $150 medical cards that i only need to go to LA of Frisco to get.

    May I ask this:

    You didn't feel it ok to take 3 lbs of medical marijuana to the hotel. But had no problem leaving a large amount of money in your car.....
