    Default Improper Speedometer Defense

    My question involves a speeding ticket from the State of: Michigan
    Statutes involving improper speedometer

    Hello everyone.... I found a statute posted on another thread refering to this statute I believe for NC...
    Quoting NCGS § 20‑123.2 Speedometer.
    --------------------------------------------------------------------------------

    (a) Every self‑propelled motor vehicle when operated on the highway shall be equipped with a speedometer which shall be maintained in good working order.

    (b) Any person violating this section shall have committed an infraction and may be ordered to pay a penalty of not more than twenty‑five dollars ($25.00). No drivers license points, insurance points or premium surcharge shall be assessed on or imputed to any party on account of a violation of this section.


    The question is does anyone know what the statute is in Michigan (Grand Traverse County) for Improper Speedometer as my Certified Mechanic is giving me documentaion that my speedometer was not funcational but since has been repaired. Court next week pleading "Not Guily" for speeding. Please help - attorney advice welcome 83/55 - 0 points on record

    Lack of a speedometer or the fact your speedo is not working is not a defense to a speeding ticket.

    In NC, not only would a person be guilty of speeding (if they were), but based on the statute you listed, they would be liable for the added offense of not having a properly operating speedo in the vehicle. Why would you ever consider such a statute to be of benefit when fighting a speeding ticket?

    I think the closest you'll come is MCL 257.783, driving or moving vehicle in unsafe condition. As jk says, it's not a defense to speeding. Even to the extent that a court might excuse speeding if a speedometer is a couple of miles per hour off, you were going 83 in a 55 - I can't imagine a judge regarding that as a problem of the speedometer as opposed to a driver with a lead foot.

    Went to court and plead not guily... will wait for court date to arrive...
