    Default Trial is Imminent and the Plaintiff Has Not Filled Anything

    My question involves court procedures for the state of: Idaho

    We are about to take part in a jury trial on friday July 9 and the Plaintiff has not completed or turned in any pre-trial paper work ( no jury instructions/ verdict forms, no witness list or evadince list). At pre trial they only asked the jude to send the case to mediation. The jude said he would not order it but if we went on our own and resolved the case that was fine, just to file papers with the court and letting them know. Other then that the trail date was up held. My question is... At trial can I motion for directied verdict? They have not supplyed anything to support there case. Also can I ask for the case to get dismised outright since they have not complyed with the courts pre-trial orders? Thanks for you input...

    So you're stating that you reached a settlement at mediation? Then why not simply formalize the settlement and either enter it as a judgment or have the plaintiff dismiss the case on payment (or whatever it was that you agreed to do)? I expect that's what the plaintiff intends.
