    Default 2 Weeks Notice - What is My Last Day

    My question involves labor and employment law for the state of: Ohio

    What is the official two week notice policy? My situation is, I resigned from my job on a Friday morning. Is that Friday considered in the 2 weeks? I would say that it is...making my last day of work two weeks on Thursday. My employer is arguing that I need to work the two weeks on Friday to make it an official two weeks notice.

    I look at the Thurs of my resignation as a day in the 2 weeks, making it: thurs, fri, mon, tues, wed, thurs, fri, mon, tues, wed, thurs = 10 days. Am I wrong in that assumption?

    There is no law anywhere in the US that requires resigning employees to provide any notice whatsoever to their employees. You could walk out the door right now (even after stating in writing that you'd stay for two weeks), never to return, and this would be perfectly legal.

    there is no official policy, rules, or requirements concerning a 2 week notice.

    Is there something lost if you do not fulfill the 2 week notice?

    but other than that, if you walked up to me on a Friday while at work and gave a 2 week notice with no other clarification, I would see it as being for the next 2 work weeks which means it would end at the end of the second Friday.

    If you want to argue little technical points, if you were at work when you gave the notice, then your notice would be through whatever time it was on the second Friday following your notice.

    If you lose nothing by not fulfilling the 2 weeks, then don't ever go back to work there again.

    Also realize that the employer has no duty to allow you to work those 2 weeks. They can simply say "we appreciate the notice but we decided to accept your resignation but will make it effective immediately" and there is nothing you can do about it.
