    Default Shoplifting Arrest and Applying for Citizenship

    In October 24, 2005 I was arrested in Houston, TX. At that time I was 20 years old. I did hired an attorney to solve my case. Recently, I realized that it is time for me to apply for citizenship. I obtained my green card back in April 2004. Filling N-400, I noticed that I had a criminal record but I have any documents related my case. I barely remember I had some kind of ID card which I received when I arrested. I searched internet on district of court in TX and found my case summary listed below:

    I remember that I had a community service as well. I'm going to request a judgment/sentece from TX tomorrow so I can disclosed all documents if USCIS asks. This was only offense I ever had except traffic tickets.
    Would I be eligible applying citizenship?? I'm very worried.. I was hesitating for last half year either apply or not.

    I will most appreciated your reply, and please let me know if there is any specific documents I should ready.

    Whenever you have a criminal history and are contemplating an immigration filing, you should consult with an attorney. Take all of your documentation about you conviction. The attorney will advise you of the proper actions to take.

    You need to obtain the following documents:

    1. court certified final disposition and
    2. certified copy of the police report.

    Once you get these documents, take them to an immigration law attorney near your area, as he or she will be familiar with how the local USCIS in your jurisdiction will handle a case like yours. There is a petty theft exception, so check with that immigration lawyer to see if you can qualify for the petty theft exception.

    A lawyer who is familiar with both the specifics of your record (the police report and final disposition sheet from the court) can give you an idea of how the USCIS office that will be reviewing your case will respond to your conviction. At a minimum, I expect you to be told to wait until five years have passed from your date of conviction before filing your petition.

    Thank you for your reply. One last question for you. Did you mean five years passed from the date I arrested or the case completion date?
