    Question Spouse Filed for Divorce, but Won't Negotiate for a Settlement

    My question involves divorce in the State of: Ohio

    Despite our mutual desire to end the marriage amicably, the Future-ex (Fex) opted to file for divorce rather than work through a dissolution settlement on the advice of his lawyer. Since filing over 14 months ago, he and his lawyer have done nothing except file for (and receive court approval for) an exorbitant amount of temporary spousal support from me. His lawyer has ignored all attempts to settle before going to trial. My lawyer made a final attempt to settle three weeks ago. The trial, scheduled three months ago, is to occur in three weeks.

    Why would the plaintiff's legal counsel recommend filing for divorce then do nothing? Why would they prefer to go to trial rather than settle?

    The only person who can explain to you what your spouse is thinking is your spouse.

    Perhaps they think your settlement offers are inadequate.

    I come from the business world where everything is "negotiated". One party offers, the other counteroffers until a mutual agreement is reached successfully (involving a 3rd party arbitrator, if necessary).

    Neither the Fex nor his counsel have made a counter-offer or provided ANY indication of what is "inadequate" or what he "wants".

    Allowing this proceed to trial means the judge decides - they abdicate their ability to influence the decision based on the circumstances of the situation. I thought all lawyers took pride in their ability to represent their client rather than hand control over to the judge.
