    Question Planning to File for Child Support

    My question involves child support in the State of: Utah

    What is the name of your state (only U.S. law)? Utah

    I am a single mom to my beautiful little girl who was born on 4/11/10. She is almost 3 months old. Her father has never once seen her and has not paid a dime in child support (willingly). I didn't put him on her BC. My mother and my best friend have been on me since day one to go after him for CS and at first I didn't think I cared but I have now decided that they are right - I just hope I really am going to be doing the right thing and am wondering what I'm in for. He has refused to be a part of her life since I told him I was pregnant so I don't think he will want any kind of visitation rights - and I'm fine with that, but I do want him to pay CS. Did I make a mistake not putting him on her BC? Will they court order a paternity test if I file for CS? My other big question is I have been doing a little research on my own and found out that since I'm 17 and he's 32 he could be charged with statutory rape if I file (because they would obviously know my age and his) - even if I and my parents don't want to press charges. Would this even enter into it? I thought 16 was legal in my state but found out that it is unless the person you had sex with is 10+ years older. I'm really worried about that possibly entering into it even if I don't want to press charges because if it did, he could end up in prison and how would that do my daughter any good. I have made an appointment for a consultation with a lawyer for this coming Monday but I'm just looking to get some advice and insight in the meantime and find out if I might be in for a real ride and if I'm even smart to do this? I just want him to help provide for my daughter - nothing more, nothing less. I just want to do what is best for her. Help! Thank you in advance!

    Seeing no one reply yet, I'll give something to read until the more knowledgibe people respond. I am surprise the father not doing back flips to keep you out of legal system.

    Normally what happens is your first case of two cases is for determining paternatity. You will take your child to a center and they will take queue tips and swab the baby inside cheeks and then make you sign some paper stating everything was done properly. Meanwhile the father will recieve an appointment at a center and they will do the samething to him.

    Then a few weeks later the results come in and if the results are positive, he is the father, then another court case is created by you to obtain child support.

    The child support is calculated based on the day you filed for PATERNITY. So he will owe you from from the start, because he is not making any payments now.

    That a normal procedure for a single not married mother 18 years or older. I Have no idea what you will be going through.

    You can do all of this through Utah's Office of Recovery Services. I wouldn't just go in for private paternity testing first thing. You want all of it to be mandated through the state so it'll all be done officially.

    However, yes - since you are a minor and he's 10+ years older than you are, there's a fairly high likelihood that he'll be brought up on charges of statutory rape.
