    Default Caught in a TABC Sting Operaiton

    My question involves criminal law for the state of: Texas

    I was working at a Valero Corner Store in Williamson County. 4th of July weekend, left alone in the store, my line had 10 people in it and the delivery truck driver came in. During all of this, TABC sent a minor in to buy alcohol. I swore the I.D. read 1984, and the girl LOOKED 26, so I didn't think twice and sold her a beer. I'm 49 and have NEVER been in trouble with the law, so am terrified and am kicking myself over and over. I was terminated immediately, which also set a precedent for me. I am totally depressed and scared, so am posting here in hopes that someone can tell me what to expect from my first offense ever. I cannot afford a fine OR lawyer, as my husband and I were both laid off our jobs in CA in 2008 and are still trying to recover from THAT.

    What do I plead? I AM guilty, but would never intentionally or knowingly sell alcohol to a minor, especially being the parent of 19 and 16 year old boys!

    I feel for you right now. Not sure how things work in Tx, but in these parts (MI) selling to an underage, first offense, normally results in a fine of between $500-$1500, with termination determined by your employer (up here we have voluntary TAM classes.... basically an alcohol management program designed for those that sell alcohol, based on the employers wishes, so if you haven't had a TAM class and are basically a good employee, you can keep your job if you agree to take the class.) I was a head bartender, and if one of my employees got busted, first offense was paid for by them, with the requirement that they take the class, if it happened again, they were terminated upon notification to the owner that they had sold to minors. We made it very clear to our employees what the protocal and laws were, and that they would be responsible for any fines that resulted from a sale on their behalf.

    You made a mistake, (I'm also a 40 something with teens and young adults), and you can't take it back. But don't beat yourself up about it (I've seen some REALLY good fake ID's and if I had not known the kids and families, I would have been busted myself....) We're human, and prone to human mistakes. Expect a fine, and explain to any potential new employers that you DID make a mistake, and next time, ppl will just have to wait in line because it won't happen again.

    I would think the corporation would WANT to keep employees whom this has happened to. All the TABC training did not teach me like this incident has. If I EVER get a job again which involves selling alcohol, I will be more prone to question every alcohol purchase. However, company policy is termination upon receipt of the citation.

    Thanks for the encouraging words, at least I don't feel so all alone. Still terrified tho, and wondering if anyone knows if I could possibly get community service or something in lieu of a fine.

    Again, not sure about Tx, but up here, you're not getting community service, you're getting a fine. From what I've been able to find for TX, it's pretty much the same, although your fines look to be more than ours. What citation code did you get? 106.?? Looks like a class A misdemeanor.
