    Default Third Degree Felony Theft

    I am 25 years old. I was caught stealing. $540.00 worth of stuff (two Items).

    I have questions:

    1. I was banned from the store. OK. Fine. The guy said he saw me steal before. He didn't write that on the police report. What are the chances he tries to come after me with the pervious case? Since, he did not state it on the police report, I feel that its low. Do you agree?

    2. Could the LPs (Loss Prevention) share my picture and information with the other stores in the same mall? If Yes, have you heard it being done?

    3. If they took the two items back, and called the police and I was charged. Do I still have to pay restitution?

    4. Also, if they did share my photo, or if they did really see me steal before. When would I find out if I was being charged with more then (1) count?

    5. Know any good lawyers in NJ? I am worried, I don't want to go to jail.

    1. Our crystal ball broke. We don't know what they will do. If you actually did steal previously, and they know about it, then they can go after you for that too.

    2. I'm not familiar enough with retail loss prevention to have heard of specific cases, but they certainly can share your picture with anyone else they want.

    3. Yes. Even if the items were recovered in salable condition, they can send you a civil demand letter for several hundred dollars; if you don't pay it, they can demand more and sue you.

    4. You'd get a summons in the mail, or arrested. At the latest, you would be informed of exactly what you're being charged with at arraignment.

    5. Sorry. I haven't had occasion to look for lawyers in New Jersey. You can look on martindale.com to see if you can find someone, and there are usually bar referral services you can look at.

    By the way....you are likely in the National Retail Theft Database. Which means retailers that subscribe to the database....NATIONWIDE....can see your name, info, and photo.

    Yes, they can distribute your info throughout the mall. And due to the monetary amount that you stole....your photo may be posted in the security office of every store in the mall...and even by employee timeclocks....

    PS: Don't forget the ban from the store includes all locations, not just the one you stole from.
