    Default Canadian got a Speeding Ticket in Michigan State

    Hi,

    I am a Canadian who got a Speeding ticket (94 on a 70) in Michigan State yesterday. The cop didn't show me the lazer readings. I paid the bond amount of $80.00 in order to get back my license. Should I fight the ticket? If so, will I be able to get the $80.00 back? What is the court cost (Berrien County Trial Court)?

    Ontario.

    and under the "Remark" section, the cop wrote: "Laser 94, 90 ,83".

    The speedometer on the rental car was too dark & small for me to see the mph. It happened on Monday afternoon, on Hwy 94, heading back to Canada.

    I still haven't called the Three Oaks Berrien Couty Trial Court for the total amount of fines.

    That's bad luck. According to the Ontario Ministry of Transportation,
    Quote Quoting Ontario Demerit Points for Out-of-Province Convictions
    Drivers convicted of a driving related offence in the State of New York, the State of Michigan or any Canadian province or territory, will have home jurisdictional penalties such as demerit points and/or suspensions applied to their Ontario driver record as if the offence occurred in Ontario.
    So to avoid Ontario points, you have to try to beat the Michigan ticket.

    In Michigan, the officer must appear for a formal hearing, so you may be able to get a dismissal if you request a formal hearing and the officer doesn't show up. If the ticket was issued by a local police officer, and the prosecution is through a city or township attorney, you have a better chance of negotiating a dismissal than if it is being handled by the County Prosecutor's Office. You may wish to try contacting a lawyer in Berrien County who handles traffic tickets, to see if they can try to negotiate a dismissal for you. (There's of course an expense in using a lawyer, but there's also time and cost involved in traveling back for a hearing.) Even if the officer shows up in court, you can try to negotiate a reduction or dismissal with the prosecutor - but "I don't know how fast I was going because I couldn't read the spedometer" isn't going to get you very far.

    It's a State police.
    Other than lawyer, will a ticket fighter do the same?
    Also, can they represent me to the hearing?

    Sorry...
    I meant, is the ticket issued by Michigan State automatically associated to my Ontario Drive License? i.e. will the State contact our Ministry of Transportation for the traffic offenses for Ontario Drivers?

    Michigan will report a ticket conviction to Ontario, which indicates that it will add the violation (or its Ontario equivalent) to an Ontario driver record. I've heard of cases where the information wasn't transmitted properly, such that Ontario either did not receive or did not record the offense, but that seems to be a rarity.

    Just wondering... if the cop doesn't show up in the Pre-Trial hearing in MI County Court, will the ticket be dismissed simultaneously? Does it matter if the court is small or not?
