    Default Emancipation age 17 in Illinois

    My question involves emancipation laws for the State of: Illinois

    Ok so me and my girlfriend have been together for about 2 years now and be are both 17(I'm 2 days older). We both have jobs and we stay at my parents house and have been for around a year well she has. My parents love her and take care of us(when we need which is hardly ever). But the real problem is her mom wants her to give half of every check she makes to pay for her mom's rent. ( her mom has 5 kids and is going threw divorce and has had her kids taking away and pays $800 a month in child support). she also wants her to live with her again but my girlfriend doesn't want to and nor does my parents or me. My mom and dad are very understandable people and have agreed that if she gets emancipated that they will have her pay rent and some utilities but will still let her save up money. (she makes no less then $900 a month and has been saving it and her mom has taken a little more then $2000 from her bank account to pay her debts). So she has a place to stay and can support her self and has been and is getting a car soon and goes to school never late and misses only when sick. She just doesn't want to pay her mom the money and live with her. (her mom also goes and parties and use to have her watch the kids like 24/7. Her mom has also said that her kids stress her out a lot and just doesn't want to pay the $800 in child support.

    Oh. her mom and real dad are divorced the other 4 kids are step brother and sisters. and she hates her real dad. he left her mom when she was pregnant. and now wants to be in her life.

    So would this hold up in court? or just not try?

    There is no court on earth that will emancipate a teen to live with her boyfriend...or her boyfriend's parents. Even IF she's paying them rent.

    Read this. Going to court and indicating that you have somebody who is willing to subsidize you going forward, but with no track record of self-support or independence, is not going to satisfy the court that you're "a mature minor who has demonstrated the ability and capacity to manage his own affairs".

    And two teenagers who started living together at age 15? Yeah, that's mature.

    Who is subsidizing YOU? Oh, your parents.
