    Default A Minor Assaulted, Threatened, What Kind of Penalty Could Follow

    i'm a 17 year old male in the state of maryland (idk if i count as a minor)

    last night, during a church retreat, a 36 year old male, twice my size came after me while I was in the basement with my two friends (similar age), and proceeded to curse at me under the belief I was insulting his family. My own family was hours away and the rest of the adults of the church were upstairs, blind to the situation. He hit me in the face and when I cursed back and tried to leave, he choked me and threatened to kill me/beat me up. As I ran away, he tried to throw a chair at me.

    Due to cultural reasons, my family strongly does not want to press charges, but I feel its unjust. The man and his family apologized repeatdly, but I'm still unsure. My question is if I go through with this, what kind of penalties and punishments will result for the man? At the very least, I would like to make him falsely believe i'm pressing charges. Also, after I press charges, will my family go through an extensive procedure? We would like to avoid such things including showing up for the trial.

    Were the police called?

    Was the assault reported?

    Criminal charges are brought by the state - so if a police report is filed, the DAs office will be the one deciding if charges occur or not. The only expense to you or your family would be if you hired a civil attorney to sue him for damages. For the criminal case, it is handled by the state on behalf of all members of society, not by you or your family.

    I have a question for the state of Wv..we were told that is you let a minor hit you 3 times, then you strike them back its cleared self defense..is this true? my 18 yr old hit a 14 yr old, after being hit 3 times first. What could we face or be charged with?

    Not even close. See the West Virginia statutes that address crimes against the person at:

    "We", nothing, unless you were somehow involved. As an adult, the 18 year old could face anything from disturbing the peace to a full out battery charge, depending on the circumstances, presence and extent of any injuries, etc. - or, he could be charged with something serious like battery and potentially plead down to something less serious.
