    Unhappy Running Away at Age 17

    My question involves juvenile law in the State of: California.

    I have a friend, age 17 with birthday in nearby September, who seeks to run away from home in the form of being harbored at another friend's home. Her reasons being: Excessive arguing, Contention, Religious Conflict, General Unhappiness.

    On her behalf I am requesting the following information:

    - What exactly her rights are as a minor in this situation
    - What action her legal parents can take to retrieve her
    - What action her legal parents can take against the harboring family
    - If she can refuse to return home
    - If she can request to be put into a chosen foster home rather than return home (the harboring mother is a certified foster parent)

    Any other information which would prove useful would be greatly appreciated.

    Federal charges against the harboring family, and the foster parent is virtually guaranteed to lose her certification.

    Her parents can force her to return home right up until the day she turns 18.

    None. She lives where her legal guardians allow her to live. If they allow her to move out, she can. If not, she can't.

    She can be entered as a runaway, and/or parents can take police to pick her up and return her to their legal authority.

    - What action her legal parents can take against the harboring family
    Criminal charges for things like harboring a runaway and interference with parental authority (also called interference with custody in some states) and a restraining order.

    - If she can refuse to return home
    When she's 18, yep.

    - If she can request to be put into a chosen foster home rather than return home (the harboring mother is a certified foster parent)
    No. That's not how it works. If child protective services determines that removal from the care of her parents is in her best interest, THEY would start that process. She doesn't get to request it. However, none of the reasons listed come anywhere CLOSE to anything that CPS is going to find problematic.
