My question involves criminal law for the state of: Ohio, Cincinnati.
My nephew just got a citation from local police and accused of selling a alcohol to a minor. He works for me and while I left that store for briefly 10 min and came back, there were 3 officers who were at the store and writing him a citation. He is 19 yrs old who have never had any problem with the law prior to this incident. According to my nephew, he have had ID(ed) checked everyone since I'd left and came back. What should he do? He has a court date in next 2 week and he's scare and I'm so upset. I'm sure police officer just didn't showed up and accused him for something he didn't did. If perhaps customer had shown my nephew such fake ID and he didn't noticed, will he still be in trouble? If it were to be the sting operation by the local PD, why didn't police show him or bring that minor to my nephew who he had sold the beer to or what type of the alcohol the minor purchased. This is a misdemeanor right? Should he go out and get a lawyer? or, should he just go plead guilty when he go to the court in 2 week from now? I heard from friend of mine and told me that the all lawyer to do just takes the money from the client and not really do anything because the nature of it's crime (misdemeanor). If he is telling me the truth and if he did infected ID the customer, and the minor was or had the fake Id as he claims is this something to argue about in the court of the law? What if local police send the minor to my store and directed him to use fake ID and my nephew didn't catched it. I am so up set and he is so scared what's gone a happen to him. Is my store in trouble? Am I in trouble because I'm the owner? Can some help us here, Please???![]()
